Pedestrian Rights in Arizona

Arizona has the largest rate of pedestrian deaths nationwide. A report published by the Governor’s Highway Safety Association states that, in the first half of 2016, the state’s pedestrian fatality rate was 4.1 fatalities for every 100,000 pedestrians. While it is clear that Arizona pedestrians are constantly exposed to danger, some are more at-risk than others.

The types of pedestrians most prone to vehicle accidents in Arizona include:

  • Runners/Joggers
  • Parents pushing buggies, carrying babies, or walking small children
  • Senior citizens and young children

Additionally, pedestrians engrossed in their smartphones or wearing earbuds are less likely to be aware of their surroundings. Due to this, they are more prone to being involved in a vehicle collision. Drivers, however, are expected to show pedestrians the highest duty of care at all times. Even if a pedestrian is listening to music or pushing a buggy at the time of the accident, this does not necessarily mean they are to blame.
