According to Arizona law, pedestrians generally have the right of way. It is the driver’s responsibility to be mindful of their surroundings and keep their eyes on the road. Even if a pedestrian is pushing a stroller, texting, wearing headphones, or is simply not paying attention, drivers are still expected to watch out for them. Pedestrians have a much higher chance of being injured when they come into contact with vehicles so the onus of accountability rests with the driver.
Insurance carriers are well aware of this. They also know that they are obligated to pay for the damages caused by the at-fault driver.
This is why an experienced pedestrian accident lawyer is necessary. While victims are recovering from their injuries, they will have someone on their side who is looking out for their best interests and making sure their rights are not trampled.
