Pedestrian Deaths in Arizona
In Arizona, pedestrians typically have the right of way. The onus of responsibility is on the driver who is expected to be aware of their surroundings and keep their eyes on the road. Regardless of whether a pedestrian is wearing headphones, texting, pushing a stroller, or generally not paying attention, drivers are still obligated to keep an eye out for them due to their increased risk of being hurt.
Insurers are fully aware of this and that they are on the hook for any damages caused by the negligent driver.
This is one of the reasons why a skilled pedestrian accident attorney is crucial. While the injured pedestrian is recovering from their injuries, they can rest assured that someone is defending their rights and has their best interests in mind.
