Pedestrian Rights in Arizona

The state of Arizona has the highest rate of pedestrian deaths in the United States. A publication released by the Governor’s Highway Safety Association reported that, in the first six months of 2016, the state witnessed a total of 4.1 pedestrian deaths out of every 100,000 residents. It is obvious that Arizona pedestrians are in a significant amount of danger, but some are more exposed to risk than others.

The kinds of pedestrians most likely to be hit by a motor vehicle in Phoenix are:

  • Joggers and runners
  • Parents walking small children or pushing strollers
  • Young children and the elderly

In addition, pedestrians who are wearing headphones or texting may not be as conscious of their surroundings and, therefore, are more likely to be involved in a collision. Motorists, however, are required to show the greatest duty of care to walkers at all times. Even if a pedestrian is pushing a baby stroller or listening to music at the time of the event, this does not mean they are inherently at fault.

When an accident does occur, pedestrians have no safety features to ensure their protection. They are fully exposed to the elements, making them subject to enduring critical and even fatal injuries when they come into contact with an automobile.

There are many kinds of driver negligence, and nearly all of them have the ability to cause wrongful death, especially that of a pedestrian. Deadly crashes often happen at intersections when motorists neglect to yield at a crosswalk. Other frequent causes of wrongful deaths include drivers who are intoxicated, drivers who speed, and drivers who fail to notice pedestrians until it is too late because they are distracted or fatigued.

Through a survival action or a wrongful death claim, specific surviving members of the victim’s family, such as children, parents, and spouses, can seek compensation for damages like medical expenses, reduced earning capacity, funeral, burial, and cremation costs, and loss of companionship.
